ACT ONE
The Karr home

It's Christmas at the Karr house. Laurie Ann comes downstairs and finds a bicycle waiting for her. Mike and Nancy stand at the top of the stairs and watch her excitement, then they fuss over her and the bike. Mike tells Laurie Ann to get dressed so she can outside and ride the new bike. After Nancy makes coffee, she and Mike talk about Laurie Ann and exchange gifts.
John Barnes returns Mike's phone call. Mike apologizes for interrupting John's holiday and asks if John would like to accompany him on a visit to Gerry McGrath. They agree to meet in an hour. Laurie comes downstairs dressed and ready to play. Mike takes the bike outside, and he and Nancy watch Laurie ride away. Nancy asks if Mike has to go out today. Mike insists that he does...it has to do with court on Monday morning.

ACT TWO
Malcolm Thomas' apartment

Cookie and Malcolm kiss. Cookie acts ashamed, and Malcolm tells her not feel that way. She explains that her family is expecting her, and she just came over to give him a Christmas present. Malcolm notes that she is a really sweet girl. A girl like that never gave him a second glance. Cookie says that she cares about him and wishes him, "Merry Christmas with all my love". She kisses him again and leaves.

ACT THREE
Gerry McGrath's hospital room

A female police guard stationed outside Gerry's room greets Mike as he arrives. She says that Gerry is awake, and Liz McGrath was already there. Mike is glad that Gerry didn't have to spend Christmas morning all alone. He then tells the guard that John Barnes will be by and should be allowed in.
Mike wishes Gerry a happy holiday and says that he asked John Barnes to come by so that the three of them could discuss Gerry's future. For a while, Gerry's future is in the hands of John Barnes.

ACT FOUR
Scene 1
Gerry McGrath's hospital room

Gerry, Mike, and John Barnes talk. Mike remarks that "Sherman said he'll think about it. At least he didin't slam the door in my face." John asks if Sherman admitted that he sold the club to Zimmerman. "No, " Mike says, "but he didn't have to because he knew it and there's point in denying it." Mike concludes that Sherman is "scared that he is in a pinch. I think he'd come through for us."
Gerry asks if Zimmerman bought the club as a front for gambling. Mike replies that there's "no doubt about it", adding that the last time he was there, he noticed that "the back room. The Crystal Room, had been closed off." John says that's the room they were planning to use. Mike confirms it and speculates that they have a special doorman, peephole, and the like. John decides that the rest of the club is used to draw a crowd. "The same way those elaborate floor shows in Las Vegas do, " Mike adds.
Mike tells John that he didn't get him to the hospital to talk about Pat Sherman. Mike has a favor to ask-- or rather, Gerry does. The trial is scheduled to resume on Monday if they determine that Gerry is fit. Mike says that they can't count on another delay. If they get one, fine. But if court resumes on Monday, Mike can't be there as he has something to do that "involves Gerry's case", but Mike says that he feels it's best not to tell John what he's doing. John wonders if Mike trusts him. Mike instructs John to acknowledge ignorance if the judge questions Mike whereabouts, after all, John won't be lying. Mike then states that he would like John to stand in for him in court. After Gerry agrees to ask John to be one of her attorneys of record, John concedes to Mike's plan, and they shake hands.

Scene 2
The Karr house

Cookie visits with Nancy, and they talk about Laurie. As Cookie starts to leave, Mike and John arrive. Mike introduces Cookie to John as "Nancy's sister Elaine, although we always call her Cookie, " then introduces John as an attorney who is joining him on the McGrath case. Cookie leaves. Mike and John sit down and discuss something that Mike didn't want brought up in front of Gerry. "Have you absolutely broken off your relationship with Otto Zimmerman?" Mike questions. John says yes, he is not Zimmerman's attorney, and he sent Otto the registered letter like Mike wanted him to. John is curious why Mike is asking. "Just to be sure, John," Mike says. "Because in the next few days or a week, I am going to start to give it to Otto Zimmerman, and I want to be sure that you're not in the line of fire," he explains.

ACT FIVE
Malcolm Thomas' apartment

The phone rings. It's Eve Morris wishing Malcolm a Merry Christmas. The reason she called is that she thought of him and decided it would be delightful if he could be there. She has some warm ginger ale for him. Malcolm is flattered. Eve says that they could talk business, and she could ask him some questions about the theatre project. "Nothing world shaking, " she says, "it just actually gave me an excuse to ask you over." Malcolm agrees and says he'll be right over.
As he gets ready to leave, Cookie comes by. She explains that her folks went to pay their Christmas visit to the Pinkertons-- Dr. Pinkerton is the president of the college. Malcolm makes an excuse and lies that he has to go to dinner with an old classmate.
